Deklarasyon sa Pagtatapos ng Pansamantalang Tigil-Putukan

Idinedeklara ngayon ng Komite Sentral ng Partido Komunista at ng Pambansang Kumand sa mga Operasyon ng Bagong Hukbong Bayan ang pagtatapos ng pansamantalang tigil-putukan na unilateral na idineklara noong Agosto 28, 2016. Ang pagtatapos na ito ay pormal na ipababatid ngayong araw sa GRP Negotiating Panel ng Negotiating Panel ng National Democratic Front of the Philippines (NDFP).

Sa pamamagitan ng deklarasyong ito at pabatid, ang unilateral na tigil-putukan ay epektibong mawawalan ng bisa sa Pebrero 10, 11:59 ng hatinggabi. 

Mga dahilan ng pagwawakas

Nagpasya kaming tapusin ang naturang unilateral na deklarasyon ng tigil-putukan sa sumusunod na batayan:

1. Hindi pa tumupad ang GRP sa obligasyon nitong iamnestiya at palayain ang lahat ng bilanggong pulitikal alinsunod sa Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law (CARHRIHL) bilang hakbanging pangkatarungan at bilang pagtupad sa pangako ni GRP President Duterte.

Ang unilateral na deklarasyong tigil-putukan ay inilabas sa batayan ng pagkakaintindihan na ang gayong pagpapalaya ay isasagawa sa loob ng 60 araw mula Agosto 28. Ito ang konteksto kung bakit lumapit ang GRP panel sa NDFP noong katapusan ng Oktubre para hingin sa PKP/BHB na palawigin ang tigil-putukan kaakibat ang pangakong palalayain ang 200 bilanggong pulitikal.

Walang pagtupad ang rehimeng Duterte sa obligasyon nito kahit pinaunlakan pa ito ng PKP ng pagpapalawig ng tigil-putukan nang hanggang 150 araw.

2. Tusong sinamantala ng GRP ang unilateral na deklarasyong tigil-putukan upang manghimasok sa teritoryo ng demokratikong gubyernong bayan.

Sa 164 munisipalidad at 43 prubinsya, sinakop ng mga armadong pwersa ang hindi bababa sa 500 baryo na nasa ilalim ng awtoridad ng rebolusyonaryong gubyerno.


Ang suspension of military operations (SOMO) at suspension of police operations (SOPO) na inilabas ng AFP at PNP bilang batayan ng unilateral na deklarasyon ng interim ceasefire ng GRP ay nagsilbi lamang lisensya ng mga armadong tropa, tauhang pulis, grupong paramilitar at death squad na maglunsad ng mga aksyong mapandigma, probokasyon o armadong kilos, paniniktik at iba pang opensibong operasyon na tinataguriang "peace and development", "civil-military", "peace and order", "kampanyang anti-droga", "medical mission" o "pagpapatupad ng batas."

Ipinataw nila ang kanilang armadong presensya sa buo-buong mga baryo at malawakang nilabag ang mga karapatang-tao, katulad ng pagsakop sa mga bahay, mga barangay hall, day care center at iba pang istrukturang sibilyan. Dumanas ang mga taumbaryo ng pagbabanta, intimidasyon at harassment ng mga sundalo ng AFP. Ang mga "counter-insurgency" na pagkontrol sa populasyon at ekonomya ay labis na nakaapekto sa produktibidad sa bukid, komersyo at kabuhayan ng masa.

Malinaw na labag sa diwa ng magkatugmang deklarasyon ng tigil-putukan, abanteng nagpakat ang AFP ng mga yunit laban sa BHB sa buong bana. Noong Enero 21, sumambulat ang armadong sagupaan nang magsagawa ng opensibang operasyon ang AFP laban sa isang platun ng BHB sa Makilala, North Cotabato, kung saan walong sundalo ang napatay. Isang Pulang mandirigma ang namartir.

Sa nagdaang mga buwan, matiyagang nagmaniobra ang mga yunit ng BHB upang umiwas sa mga opensibong operasyon ng AFP na tumindi nitong nagdaang mga linggo. Magaganap at magaganap ang mga armadong sagupaan sa nagdaang mga araw dahil walang habas ang mga opensiba ng AFP, sa isang panig, at sa kabilang naman, ay ang aktibong pagtatanggol ng BHB sa interes ng bayan.

Pagsuporta sa usapang pangkapayapaan

Kahit pa tinatapos namin ang unilateral na deklarasyon ng tigil-putukan, patuloy naming sinusuportahan ang negosasyong pangkapayapaang GRP-NDFP sa balangkas ng The Hague Joint Declaration of 1992. Sa karanasan namin at ng ibang bayan, posibleng magnegosasyon at makipaglabanan hanggang mabuo ang mga sustantibong kasunduan na lumulutas sa mga ugat ng armadong tunggalian at mailatag ang batayan para sa makatarungan at pangmatagalang kapayapaan.

Tinututulan namin ang paggamit sa mga pansamantalang tigil-putukan bilang batayan para sa pangmatagalan o walang taning na tigil-putukan na walang makabuluhang pakinabang para sa mamamayan at kanilang rebolusyonaryong pwersa at para isaisantabi ang pagharap sa mga sustantibong usapin tulad ng mga repormang panlipunan, pang-ekonomya at pampulitika. Ang gayo’y katumbas na rin ng kapitulasyon at pasipikasyon ng rebolusyonaryong mamamayan at mga pwersa. 

Atas

Mula ngaon hanggang tuluyang pagkawala ng bisa ng deklarasyong tigil-putukan, lahat ng kumand at yunit ng BHB, kabilang ang milisyang bayan at yunit pananggol-sa-sarili, ay dapat mas puspusang magsagawa ng aktibong depensa upang ipagtanggol ang kapakanan ng bayan at rebolusyonaryong pwersa.

Dapat nilang kunin ang inisyatiba upang kontrahin, biguin at parusahan ang mga yunit ng AFP, PNP, CAFGU na nagpapatrulya sa mga sonang gerilya, ang mga yunit ng kaaway na sumasakop sa mga barangay at komunidad, ang mga opensibang operasyong nagpapanggap na anti-droga o anti-krimen, na pawang yumuyurak sa diwa ng magkatugong deklarasyong tigil-putukan.

Sa tuluyang pagtatapos ng deklarasyon, lahat ng panteritoryo at yunit kumand ng BHB ay inaatasang kunin ang buong inisyatiba sa pagpaplano, pagkokoordina at paglulunsad ng mga kampanyang militar at taktikal na opensiba laban sa reaksyunaryong Armed Forces of the Philippines (AFP), sa Philippine National Police (PNP), sa iba't ibang mga grupong paramilitar at death squad ng rehimeng Duterte, pati na ang mga armado, abusado at mapandambong na negosyo at iba pang armadong grupo at sindikato na sumasalanta sa interes ng bayan at mga rebolusyonaryong pwersa sa mga rebolusyonaryong teritoryo. Dapat ipagtanggol ng BHB ang bayan at ang kanilang mga rebolusyonaryong pwersa at kamtin ang marami pang rebolusonaryong tagumpay.

Patuloy ring ipatutupad ng BHB ang mga patakaran at batas ng demokratikong gubyernong bayan, ipatutupad ang kinakailangan at nararapat na mga gawain sa paggugubyerno, at pakikilusin ang mamamayan at mga rekurso sa mga teritoryong nasa saklaw nito. Sa partikular, ipatutupad ng BHB ang mga patakaran sa ekonomya na pumapatungkol sa upa sa lupa, sa pag-uusura, sahod, hanapbuhay at pagbibigay ng mga serbisyong panlipunan; pati na ang mga patakaran para sa pangangalaga sa kalikasan at pagtatanggol sa interes ng mga pambansang minorya, magsasaka at mga manggagawa na sinasalanta ng malalaking operasyong pagmimina, pagtotroso at plantasyon.

Dagdag pa, bilang organisasyong pangkultura, pampulitika at panserbisyo, patuloy na ipapakat ng BHB ng mga pwersa nito upang isagawa ang mga kampanyang pang-edukasyon at literasi, mga aktibidad pangkultura, misyong pangkalusugan at kampanyan para suportahan ang produksyon.

Declaration terminating the unilateral interim ceasefire

The August 28, 2016 unilateral declaration of interim ceasefire issued by the Central Committee of the CPP (CPP-CC) and the National Operations Command of the New People’s Army (NPA-NOC) is hereby terminated. The Negotiating Panel of the Government of the Republic of the Philippines (GRP) shall be given notice today of this termination by the Negotiating Panel of the National Democratic Front (NDFP).

With this declaration and notice, the August 28 unilateral ceasefire shall effectively expire on 11:59 p.m. of February 10. 

Reasons for termination

We have decided to terminate the aforesaid unilateral declaration of interim ceasefire for the following reasons:

1. The GRP has not complied with its obligation to amnesty and release all political prisoners under the Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law and the Joint Agreement on Safety and Immunity Guarantees as a matter of justice and in fulfillment of the promise of President Duterte.

The unilateral ceasefire declaration was issued on the mutual understanding with the GRP that such releases will take effect within 60 days of August 28. Such was the context why the GRP panel approached the NDFP towards the end of October seeking an extension of the CPP/NPA’s declaration with a promise that around 200 political prisoners were set to be released.

The Duterte regime failed to fulfill such obligation even though the CPP obliged it by extending the ceasefire declaration to more than 150 days.

2. The GRP has treacherously taken advantage of the unilateral declaration of interim ceasefire to encroach on the territory of the people’s democratic government. 

Across 164 municipalites and 43 provinces, the GRP’s armed forces have occupied at least 500 barrios which are within the authority of the revolutionary government.

The suspension of military operations (SOMO) and suspension of police operations (SOPO) issued by the AFP and PNP as basis of the GRP’s unilateral declaration of interim ceasefire have served as license for its armed troops, police personnel, paramilitary units and death squads to engage in hostile actions, provocations or movements, surveillance and other offensive operations that are labelled as “peace and development”, “civil-military”, “peace and order”, “anti drugs campaign,” “medical missions” or “law enforcement.”

They have subjected entire barrios to their armed presence and have committed widespread violations of human rights, such as occupation of people’s homes, barangay halls, day care centers and other civilian structures. People have suffered threats, intimidations and harassments by AFP soldiers in their barrios. These “counter-insurgency” population and resource control have gravely affected the people’s farm productivity, commerce and overall livelihood.

In clear violation of the spirit of the reciprocal ceasefire declarations, the AFP has forward deployed its units against the NPA across the country. On January 21, a firefight broke out as the AFP waged offensive operations against an NPA platoon in Makilala, North Cotabato, resulting in eight soldiers killed. An NPA Red fighter was martyred.

Over the past months, NPA units have maneuvered to evade AFP offensive operations which have heightened over the past weeks. Armed skirmishes over the past days were bound to erupt in the face of relentless and heightened AFP offensives, on the one hand, and efforts of the NPA to actively defend the people’s interests, on the other.

Continuing support for peace negotiations

Even as we terminate the unilateral declaration of interim ceasefire, we continue to support the GRP-NDFP peace negotiations within the framework of The Hague Joint Declaration of 1992. In our experience and in the experience of other peoples, it is possible to negotiate while fighting until the substantive agreements are forged to address the roots of the armed conflict and lay the basis for a just and lasting peace.

We oppose the use of interim ceasefires as basis for a protracted or indefinite ceasefire without substantial benefit for the people and their revolutionary forces and for laying aside peace negotiations on substantive issues such as social, economic and political reforms. Such is tantamount to the capitulation and pacification of the revolutionary people and forces.

Order

From today until the expiration of the ceasefire declaration, all commands and units of the NPA, including the people’s militia and self-defense corps, are tasked to take initiative and more vigorously carry out active defense in order to defend the people and revolutionary forces. 

They must counteract, frustrate and punish AFP-CAFGU-PNP interior patrol operations, AFP psywar operations under Oplan Kapayapaan, AFP units occupying barangays and communities and enemy armed offensives posing as anti-drug and anti-crime operations. 

Subsequent to the expiration of our unilateral ceasefire, all territorial and unit commands of the NPA are hereby ordered to take full initiative in planning, coordinating and carrying out military campaigns and tactical offensives against the reactionary Armed Forces of the Philippines (AFP), the Philippine National Police (PNP), the various paramilitary units and death squads of the Duterte government, drug traffickers and operators of the drug trade and large-scale gambling, private armies and private armed groups of warlords, local tyrants as well as spies. 

The NPA will also continue to enforce policies and laws of the people’s democratic government, perform necessary and appropriate functions of governance, and mobilize the people and resources in territories under its authority. In particular, the NPA will enforce economic policies pertaining to land rent, usurious loans, wages, means of livelihood, provision of social services; as well as policies for the protection of the environment and defense of the interests of national minorities, peasants and workers affected by large-scale mining, logging and plantation operations.

Furthermore, as a cultural, political and service organization, the NPA will continue to dispatch its forces to carry out education and literacy campaigns, cultural activities, medical missions and production support campaigns.
